If your car insurance claim was rejected, you have the right to a written reason and to appeal it - start by asking the insurer for the exact policy clause they relied on, then put your appeal in writing with the facts and evidence that contradict the rejection. If they still refuse, escalate free of charge to the Ombud (OSTI / NFO).

Many rejections are reversed once the insurer rechecks the file or the Ombud reviews it. Stay factual, cite the policy, and keep every document.

Step 1: get the reason in writing

Before appealing, you need to know exactly why they said no. Email and ask for:

  • The written reason for the rejection.
  • The specific policy clause or exclusion relied on.
  • Any report (assessor, investigator) they based it on.

You cannot effectively appeal a vague 'no'. Pin down the precise ground first.

Common rejection reasons you can challenge

  • Alleged late notification - show when you actually reported it.
  • Alleged non-disclosure - show what you did declare.
  • Roadworthiness - show the fault did not cause the loss.
  • Excluded circumstances - show your situation does not fit the exclusion.
  • Driver not covered - show the driver was permitted under the policy.

Step 2: escalate to the Ombud

If the insurer upholds the rejection and you still disagree, refer it to the Ombud for Short-Term Insurance (now within the National Financial Ombud).
